AUTHORIZATION FOR PARTICIPATION AND WAIVER OF ALL CLAIMS
The (“Participant”) wishes to participate in dance activities hosted by The Assembly Committee (“Assembly”).
PARENT AUTHORIZATION FOR PARTICIPATION
I am the parent or guardian of the above identified Participant and authorize my child to participate in The Assembly Committee dance activities scheduled for the above listed school year.
I have read and understand the Assembly Committee Zero Tolerance Policy, the Non-Discrimination Policy, and the Standing Rules of the Assembly Committee for participating in the dance activities scheduled for the above listed school year. I agree to the policies and rules of the Assembly Committee and understand and agree that strict compliance with the policies and rules is required for my child to participate in the activities.
ADULT WAIVER OF LIABILITY - ACTIVE MEMBERS
Waiver: In consideration of permission to participate in Assembly, I, myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue Assembly, its chapters, its directors, officers, employees, volunteer leaders, volunteers, and agents (collectively the “Assembly Parties”) from liability from any and all claims including the negligence or gross negligence of the Assembly Parties, resulting in personal injury, accidents, infectious diseases or illnesses (including death), and property loss arising from, but not limited to, participation in activities, classes, observation, and use of facilities, premises, or equipment.
Assumption of Risks: I/we understand that this activity is for students from all geographic areas and schools throughout the community and I/we further understand that Assembly cannot be a guarantor of my/our child’s safety at all times before, during or after the activity. As a result, I/we hereby waive all claims which I/we might have against the Assembly Parties for any injury, accident, illness or death occurring during or by reason of the above described activity. Physical activity, by its very nature and the use of Assembly equipment, supplies, and/or services carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. Assembly provides participants opportunities to participate in social events to develop social skills and connection with teens across San Diego County. Some of these events may involve situations, environments, individuals or activities that may lead to illness, physical injuries, and psychological stress or damage. The specific risks vary from one activity to another, but the risks range from 1) minor injuries such as scratches, bruises, strains, sprains, heat exhaustion, dehydration and embarrassment 2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, exposure to viruses or infectious diseases, concussions, and psychological trauma 3) catastrophic injuries including paralysis and death. I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in the activities made possible by Assembly. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.
Indemnification and Hold Harmless: I also agree to INDEMNIFY AND HOLD the Assembly Parties HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees brought as a result of my involvement in Assembly and to reimburse them for any such expenses incurred. Furthermore, I/we accept full responsibility for Participant’s conduct before, after and during the activity and agree to hold harmless as to indemnify the Assembly Parties for any and all liability resulting from my child’s conduct while a participant at the activity.
Severability: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
PREVENTING SEXUAL MISCONDUCT - PARTICIPANTS
The Assembly Committee (“Assembly”) serves teenagers throughout San Diego County. It is important that Participants know appropriate boundaries and understand their duties and responsibilities with respect to sexual misconduct. By following the guidelines established in the Assembly Preventing Sexual Misconduct Policy, Assembly Participants will protect themselves, chaperones, and all participants.

Assembly events are structured group social events, with parent chaperones attending with the teenage Participants in accordance with the mission statement.●

Assembly is committed to making the events free from sexual misconduct or harassment, intimidation, and bullying. Such behavior is strictly prohibited.

Sexual jokes, comments of a sexual nature, kissing, touching, crude gestures, and the like are not appropriate behavior and are prohibited for any Participant, chaperone or volunteer.

Revealing or discussing personal information about one’s sex life by a Participant, chaperone, or volunteer is not appropriate.

When it is necessary to speak to someone privately, find a place out of earshot, but within sight of the others from your group.
Assembly will take seriously every allegation of abuse, misconduct or harassment by its participants and chaperones and requires every allegation to be reported immediately to the the Dance Chair and President. The Board shall gather information and contact authorities as appropriate.
WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. According to the Centers for Disease Control, COVID-19 is extremely contagious and spreads mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
The Assembly Committee (“Assembly”) has put in place preventative measures to reduce the spread of COVID-19. However, Assembly cannot guarantee that you or your teen/minor will not become infected with COVID-19. Further, attending Assembly events and programs could increase your risk and your teen/minor’s risk of contracting COVID-19.
By signing this document, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my teen/minor and I may be exposed to or infected by COVID-19 by attending Assembly activities and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Assembly events may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Assembly events, program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my teen/minor or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my teen/minor may experience or incur in connection with my teen/minor’s participation in Assembly programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Assembly, its agents and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of Assembly, its volunteers, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Assembly event.
Acknowledgment of Understanding: I have read this Assumption of Risk and Waiver of Liability Relating to Coronavirus/COVID-19, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature for this agreement to be a complete and unconditional release of all liability to the greatest extent allowed by law. I am the parent/guardian of the minor/teen listed above and I am signing this Assumption of Risk and Waiver of Liability Relating to Coronavirus/COVID-19 on behalf of said minor/teen and for myself.
